In response to Mr Justice Arnold’s comments in Burgess v BIC UK Ltd [2018], we thought it would be helpful, if we published a factsheet setting out our view that the Pensions Ombudsman is a ‘competent court’ for the purpose of section 91(6) of the Pensions Act 1995, when making Determinations for recoupment in overpayment cases.
