 Complaint summary

Mrs N’s complaint against TP concerns the administrative and procedural problems she experienced in respect of the transfer of her benefits from the Scheme to the University Superannuation Scheme (the USS). In particular her complaint is about:

  1. the failure to inform her of the offer made in 2005 about the proposed transfer of her benefits from the Scheme to the USS;
  2. the calculation in September 2008 of her entitlement in respect of a claim relating to the retrospective part-time service (Preston) with the University College of Winchester (UCW) – which showed a total of 5 years 2 days pensionable service for the period worked before 2003, but, because of an unexplained reduction (to 3 years 267 days), it was not on public sector transfer club (Club) basis and the pension she received under USS was based on 1 year 343 days;
  3. the offer made in 2010 to pay her pension benefits from the Scheme, upon which she based certain decisions, and the subsequent withdrawal of that offer; and
  4. the transfer of her benefits to the USS in 2011, which should have been on a Club basis.

Summary of the Ombudsman’s decision and reasons

The complaint should not be upheld against TP because I find that there has been maladministration by TP in only one case and I do not find that Mrs N has suffered an injustice as a result of that particular maladministration.
