2. Astar Services Limited (ASL)
2. Astar Services Limited (ASL)
Complaint Topic: Administration
Ref: PO-309
Outcome: Not upheld
Respondent: A J Bell Ltd and AJ Bell Trustees Ltd (together AJ Bell)
Type: Pension complaint or dispute
Date:
Subject
The complaints are that AJ Bell:
- did not provide prompt assistance in establishing a discretionary trust;
- incorrectly completed the pension scheme accounts which could have had serious consequences with HMRC.
The Pensions Ombudsman’s determination and short reasons
The complaint should not be upheld against AJ Bell because they have not acted unreasonably in asking ASL to pay for their legal costs when they arranged the discretionary trust and the Trustees, including Mr Mole, should have been aware of the provisions of the Scheme.
