I do not uphold Mr Scargill’s complaint and no further action is required by either the NUM or the Trustees.
My reasons for reaching this decision are explained in more detail below.
Complaint summary
Mr Scargill has complained that his pre-1997 pension has not been increased in line with the annual increase in the Retail Prices Index (RPI) for the year 2014. He considers this to be in breach of an agreement reached in 1975.
