Complaint Summary
Mr R has complained that the overtime pay he received from Wetton should have been included in his pensionable pay for the purpose of calculating his retirement benefits under the Scheme, and that Wetton and Capita caused delays in providing relevant information.
Summary of the Ombudsman’s Determination and reasons
The complaint should be partly upheld against Wetton because:
- Mr R’s overtime work was not pensionable, but Wetton deducted Mr R’s pension contributions from his pay incorrectly, calculating them by reference to his gross pay; and
- Wetton unreasonably delayed the provision of information that Capita needed in order to issue Mr R’s benefit statements .
The complaint against Capita should not be upheld because Capita had to rely on Wetton to provide it with accurate information about Mr R’s pensionable pay.
