NHS Pension Scheme (PO-26020)
Ombudsman’s Determination
Outcome
I do not uphold Mr T’s complaint and no further action is required by NHSBSA.
My reasons for reaching this decision are explained in more detail below.
Complaint summary
Mr T has complained that NHSBSA has failed to give a proper account of its actions and decisions regarding the distribution of the death in service benefit following the death of his brother. Furthermore, there was maladministration:-
by the staff in either their responses to his initial enquiries and complaints, or by the staff dealing with his formal complaints; and
because NHSBSA did not undertake sufficient due diligence in the allocation of the lump sum.
