I do not uphold Mr Y’s complaint and no further action is required by Lloyds TSB.

My reasons for reaching this view are explained in more detail below.

Complaint summary

Mr Y’s complaint is that:

  • In 2012 when he rejoined the Lloyds TSB Banking Group (the Group) as an employee of HBOS plc, he should have been reinstated back into the Scheme. He was previously an active member of the Scheme before his employment was transferred out of the Group in 2007.
  • He received pension mis-selling compensation from the Financial Services Compensation Scheme (FSCS) in relation to a complaint about a firm of independent financial advisers. He says that Lloyds TSB should now accept that payment into the Scheme.
