Mr Y’s complaint is upheld and, to put matters right, Devon & Cornwall Police shall arrange for the overpayment of his pension to be recalculated to take account of the effect of the Limitation Act 1980. In addition, it shall pay Mr Y £2,000 for the severe non-financial injustice.
