Complaint summary

Dr N was in receipt of a spouses’ pension which ceased in November 2016, when he informed TP that he was remarried. TP has requested repayment of an overpayment that occurred from 7 July 2010, the date Dr N remarried, up until the pension was stopped in 2016.

Mr K’s complaint against the Trustee is partly upheld, but there is a part of the complaint I do not agree with. To put matters right, for the part that is upheld, the Trustee should pay Mr K £500 for the significant distress and inconvenience it caused him.

Mr D says his pension was overpaid by £1,963 as a result of Council’s delays and mistakes in implementing his pension sharing order (the PSO). He does not believe that he should have to repay this amount.

Mr K is unhappy because Equiniti, on NHS BSA’s behalf, is seeking to recover an overpayment from him in relation to a Permanent Injury Benefit (PIB) award he receives from the Scheme.

NHS BSA has confirmed that an overpayment accrued because Mr K’s PIB award began to be paid before it had been abated.

Mr N’s complaint should be partly upheld in that RMSPS should write off the overpayments which are subject to a limitation defence. RMSPS is able to recover the overpayment which occurred from 13 March 2011 onwards.

Mr Y’s complaint against Equiniti and Veterans UK is partly upheld, but there is a part of the complaint I do not agree with.  To put matters right for the part that is upheld, Equiniti and Veterans UK shall write off that part of the overpayment the recovery of which is statute barred.
