Complaint summary

Mr N was overpaid a widower’s pension from the Scheme which he was not entitled to, as he remarried. Mr N complains that TP is now seeking recovery of the overpayment.

Dr E has complained that NHSBSA have incorrectly requested the return of an overpayment of pension which it is claimed is based on the equal distribution of profits between him and his wife. Dr E says the profits were not shared equally between him and his wife and pension contributions were paid on this basis.

Mrs N has complained that she received benefits from the Scheme to which she was not entitled and the Trustee is now seeking recovery of the overpayment. Mrs N says that had the Trustee provided her with the correct information, she would not have retired and would have continued to work.

Complaint summary

Mrs S is unhappy because her reckonable service for pension benefits was reported by NYCC incorrectly, and subsequently recorded incorrectly by TP, several times. As a result of this, she has been overpaid £5,585.13.

NYCC was Mrs S’ employer, and TP is the administrator for the Scheme.

I do not uphold Mr G’s complaint and no further action is required by CCC or YPS.

My reasons for reaching this decision are explained in more detail below.

Complaint summary

Mr G is unhappy because he has been asked by YPS and CCC to repay pension income which he has already paid to his ex-wife. He therefore states he has effectively had to pay this money twice. YPS and CCC have said there was an overpayment, and that this is the amount that has been recovered from Mr G.

Mr D’s complaint against Atkin and the Trustees is partly upheld, but there is a part of the complaint I do not agree with.

To put matters right (for the part that is upheld) the Trustees should write off the overpayments which are subject to limitation defence. The Trustees are able to recover the overpayments which occurred from 25 May 2010 onwards.
