Dr Marchant has complained that an overpayment of pension arose as a result of LSBU incorrectly submitting forms to TP and TP paying his pension incorrectly.

Summary of the Ombudsman’s determination and reasons

The complaint should be upheld against LSBU to the extent that they contributed to the situation Dr Marchant finds himself in because they submitted an incorrectly completed form to TP.

Mrs Lomax argues that she should not be required to pay the outstanding unpaid employee pension contributions or the interest that has accrued as a consequence of her failure to pay them to date. The complaint should be partly upheld against City of London because they failed to identify at an early stage that Mr Aldridge had been re-employed.  However, I do not uphold the substantive complaint that they failed to inform him that his pension could be affected by his re-employment.
