Outcome

Mr E’s complaint is upheld and to put matters right the Council should reconsider Mr E’s application for an ill health retirement pension (IHRP).

My reasons for reaching this decision are explained in more detail below.

Complaint summary

Mr E’s complaint against the Council is that it failed to consider him for an IHRP when he was dismissed from his employment on the grounds of ill health. Mr E would like his deferred ill health pension, that he was awarded in 2015, to be backdated to 2009, when his employment was terminated.
