I partially uphold Mrs S’s complaint against Teachers’ Pensions and find in her favour on some of the points of law referred to me.

Mrs S has complained that Teachers’ Pensions is seeking to recover an overpayment of her widow’s pension under a TPS regulation which provides for a spouse’s pension payable after the member’s death to cease on subsequent remarriage or cohabitation.
