Smart Pension Master Trust (CAS-32892-M2C1)
Ombudsman’s Determination
Outcome
Mr G’s complaint is upheld and, to put matters right, the Employer shall pay the missing contributions into the Scheme. It should also make an additional payment into the Scheme, being the investment return that the contributions would have received had they been invested on time. In addition, the Employer shall pay Mr G £1,000 for the serious distress and inconvenience it has caused him.
Complaint summary
Mr G complained that the Employer, despite deducting pension contributions from his pay, has failed to pay some of these into the Scheme. It also paid a number of pension contributions into the Scheme late.
Although the majority of the unpaid contributions have now been paid into the Scheme, pension contributions deducted from his pay amounting to £366.85 have still not been remitted. The Employer has also not arranged for any investment loss to be calculated and paid into the Scheme or made any award for the distress and inconvenience caused.
