Ombudsman’s Determination
Outcome
Mr D’s complaint is upheld and, to put matters right, the Employer shall pay the missing contributions in respect of his pension and make good any shortfall in units. The Employer should also ensure that the employer contributions match the employee contributions.
In addition, the Employer shall pay Mr D £1,000 for the serious distress and inconvenience it has caused him.
Complaint summary
Mr D has complained that the Employer, despite deducting contributions from his pay, has failed to pay them into the Scheme.
As well as the failure to remit pension contributions, Mr D has complained that the Employer has not paid the correct level of employee and employer contributions as provided in the Terms and Conditions of his employment (the Employment Contract).
