Mr Y’s complaint concerns the Council’s decision to refuse his application for early payment of retirement pension on ill health grounds.

Complaint summary

The complaint is upheld because the Council did not fully satisfy the requirements of the Local Government Pension Scheme Regulations (the 2013 Regulations) and the Statutory LGPS Ill Health Retirement Guidance (the Guidance).

The Council shall make a new decision and record whether Mr Y was permanently incapable of discharging efficiently the duties of the employment in which he was engaged. Also, if necessary, the Council shall consider whether Mr Y was immediately capable of undertaking any other form of gainful employment.
