Outcome
I do not uphold Mr R’s complaint and no further action is required by the Trustee.

Mr T’s complaint against the Employer and Mercer is partly upheld.
Mr E’s complaint is upheld and to put matters right Capita should pay Mr E his retirement benefits on the basis that he would have chosen a lump sum and reduced pension, rather than a full pension.
Mr R’s complaint against the Trustees is partly upheld. To put matters right the Trustees shall pay Mr R £500 for the significant distress and inconvenience caused to him.
Mrs Y’s complaint against NHS BSAis partly upheld.
The Applicants’ complaint is upheld in part, and to put matters right Hartley shall:
