Outcome
I do not uphold Ms R’s complaint and no further action is required by Westerby.

I do not uphold Mr R’s complaint and no further action is required by the Trustee.
Mr R’s complaint against Westbridge is partly upheld. To put matters right, Westbridge SSAS shall:-
Pay Mr R the sums described under my Directions in paragraphs 92.1 to 92.3, below; and
Ms S’ complaint is upheld and, to put matters right, the Employer should pay £678.30 into the Scheme. The Employer should ensure that Ms S is not financially disadvantaged by its maladministration. So, it should arrange for any investment loss to be calculated and paid into the Scheme.
I do not uphold Mrs Y’s complaint, and no action is required by Royal London.
I do not uphold Mr T’s complaint, and no further action is required by the Employer.
Mrs N’s complaint against the Council is partly upheld. To put matters right, the Council shall pay Mrs N £2,500 in recognition of the exceptional distress and inconvenience it caused her.
The complaint should not be upheld against NHS BSA, because the application and retention of regulation G1 of the NHS Pension Scheme Regulations 1995 amounts to a proportional means of achieving a legitimate aim. Mrs E’s claim of a breach of human rights has failed in this instance.
I do not uphold Ms N’s complaint. However, NHS BSA, should calculate and provide Ms N with an early retirement quotation detailing the benefits that could currently be paid to her.
I do not uphold Mr Y’s complaint and no further action is required by CPLAS Trustee or Capita.
