Mr T’s complaint is upheld and, to put matters right, the Cheshire Service shall take the actions set out in paragraph 105.
I do not uphold Mr E’s complaint, and no further action is required by the Trustee or the Administrator.
The complaint should be partly upheld against Aviva and upheld against the Trustees.
The complaint is partly upheld against Aviva because: -
I do not uphold Mr N’s complaint and no further action is required by CSP.
I do not uphold Ms R’s complaint and no further action is required by NHS BSA.
I partly uphold Mr S’ complaint and ReAssure shall pay Mr S £500 for the significant distress and inconvenience he has experienced less the £200 it has already paid him.
I do not uphold Mr N’s complaint, and no further action is required by Prudential.
Mr E’s complaint is upheld and, to put matters right, the Employer shall pay £4,967.24 into the Scheme. The Employer shall ensure that Mr E is not financially disadvantaged by its maladministration. So, it shall arrange for any investment loss to be calculated and paid into the Scheme.
I do not uphold Mr S’ complaint and no further action is required by the Fund beyond that already taken.
I do not uphold Mrs A’s complaint, and no further action is required by SPT.
My reasons for reaching this decision are explained in more detail in paragraphs 51 to 59 below.
