Mr S’ complaint is upheld and to put matters right, BSSL shall comply with the Directions set out in paragraphs 21 to 23 below.

Complaint summary

Mr S complains that pension contributions have not been paid into his Plan. He says that as a result of this, he has been unable to claim his pension and has relied on his savings instead. He would like all contributions and tax relief to be applied to his Plan, and for this to reflect what he would have received, had the contributions been allocated on time.

The Applicants’ complaints are upheld and to put matters right, the Respondent shall pay pension contributions into the Scheme, on the Applicants’ behalf, for the period from (a) 8 April 2015 to (b) the date he started paying pension contributions to the Scheme, on their behalf, in November 2017.

The Respondent will ascertain from Nest what if any is the investment return in respect of the missing contributions and pay such return into the Scheme.

Mrs R’s complaint is upheld and to put matters right Teddy shall ensure that all of the unpaid employer and employee contributions are paid into Mrs R’s Scheme pension. Teddy shall also pay an amount equal to the notional fund value had the contributions been paid into the Scheme at the time when they should have been (if higher than the value of the contributions alone). Teddy shall also pay Mrs R £2,000 for the severe distress and inconvenience caused to her.
