Complaint Summary
Mrs K has complained that NHS BSA’s decision to recover an overpayment of Personal Injury Benefit (PIB), which was paid by the Scheme, is unfair.
Mrs K has complained that NHS BSA’s decision to recover an overpayment of Personal Injury Benefit (PIB), which was paid by the Scheme, is unfair.
Dr T’s complaint against USS Ltd is partly upheld. USS Ltd is able to recover overpayments made on and after December 2011 by way of repayment, but not those made earlier. However, USS Ltd may recoup the full amount from Dr T’s future pension in payment.
My reasons for reaching this decision are explained in more detail below.

Dr S disagrees with USS Ltd’s decision to recoup an overpayment of pension and tax free cash lump sum from his current pension payments.
Mrs R’s complaint concerns what NHS BSA has termed an overpayment of her pension benefits; it is seeking the return of these funds.
Mrs R does not consider that she has been overpaid and has alluded to an agreement with her former employer regarding the payment of these benefits.
I do not uphold Mrs Y’s complaint and no further action is required by Teachers’ Pensions.
Mrs Y has complained that Teachers’ Pensions is seeking to recover an overpayment of her widow’s pension arising as a result of her co-habitation.
Mr Y’s complaint against the Trustee is partly upheld, but there is a part of the complaint I do not agree with. To put matters right for the part that is upheld, the Trustee shall pay Mr Y £1,000 for the serious distress and inconvenience he has suffered.
Mrs T’s complaint is upheld and to put matters right the Cabinet Office shall notify Mrs T of its decision to waive the revised debt.
